Terms of Use

Welcome to Artefakt Family. By creating an account or using artefakt.family and related services (the "Service"), you agree to these Terms of Use, together with our Privacy Policy. If you do not agree, please do not use the Service. The Service is operated by Artefakt Inc., whose registered office is 7321 S. South Shore Dr. 11D, Chicago, IL 60649, United States. "You" refers to the account holder.
YOUR CONTENT
You keep ownership of everything you upload — your photographs, film, recordings, and documents ("Your Content"). You grant us a limited licence to store, back up, process, and display Your Content solely to provide the Service to you and the family members you invite, including generating suggested captions through our captioning provider. We do not claim ownership of Your Content and we do not sell it, license it to third parties, or use it for advertising.
YOUR RESPONSIBILITIES
You agree that you will not use the Service to:
- Upload content you do not have the right to upload, or that infringes anyone’s copyright, privacy, or other rights;
- Upload unlawful, harmful, or abusive content;
- Upload any content that sexually exploits or endangers a minor. Child sexual abuse material is strictly prohibited; any such material discovered will be removed, preserved as required by law, and reported to the National Center for Missing & Exploited Children and to law enforcement in accordance with 18 U.S.C. § 2258A;
- Share content depicting other people — including children — in a way that violates their privacy or applicable law. You are responsible for obtaining any consent needed from the people in your archive;
- Attempt to access another family’s archive, or interfere with the security or operation of the Service;
- Resell or commercially exploit the Service without our written permission.
You are responsible for the activity on your account and for keeping your password secure.
FAMILY MEMBERS AND ACCESS
As the account holder, you control who is invited to your archive and what each member can see and do. Invited members may view and contribute according to the access you grant, and must also follow these Terms. You can change or revoke a member’s access at any time.
RESPONSIBILITY FOR CONTENT; REMOVAL AND REPORTING
You are solely responsible for the content you and your invited members upload, and for the consequences of doing so. We do not pre-screen or undertake any obligation to monitor content, and we are not responsible or liable for content uploaded by users. We may review, refuse, remove, or disable access to any content at any time, in our sole discretion, where we believe it violates these Terms or applicable law. Removal is not an admission of any kind. We may preserve content and account information and disclose it to law enforcement or other authorities where we believe in good faith that doing so is required by law or necessary to protect the rights, safety, or property of any person.
COPYRIGHT COMPLAINTS (DMCA)
We respond to clear notices of alleged copyright infringement consistent with the Digital Millennium Copyright Act ("DMCA"). If you believe content on the Service infringes your copyright, send a written notice to our designated agent at jon@artefakt.foundationthat includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and information reasonably sufficient to locate it; (4) your contact information; (5) a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf. We will remove or disable access to material that is the subject of a valid notice and, in appropriate circumstances, terminate the accounts of repeat infringers.
SUBSCRIPTIONS, TRIALS, AND BILLING
Some features require a paid plan. Where a free trial is offered, you may cancel before it ends to avoid being charged. Paid plans renew automatically until cancelled; you can cancel at any time and your plan will remain active until the end of the current billing period. Fees are non-refundable except where required by law. Payments are processed by Stripe.
AVAILABILITY AND YOUR BACKUPS
We work hard to keep your archive safe and available, and we maintain backups. The Service is nonetheless provided "as is," and we recommend you keep your own copies of irreplaceable originals. We do not warrant that the Service will be uninterrupted or error-free.
TERMINATION
You may stop using the Service and request deletion of your account at any time by contacting us. We may suspend or terminate an account that violates these Terms, or to comply with the law, and will give you reasonable notice where we can so that you can export Your Content.
LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, ARTEFAKT INC. EXCLUDES IMPLIED WARRANTIES AND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
You agree to indemnify and hold Artefakt Inc. harmless from claims arising out of content you upload or your breach of these Terms or the rights of others.
GENERAL
These Terms are governed by the laws of the State of Illinois, and the state and federal courts located in Cook County, Illinois are the agreed forum for any dispute. If any provision is found unenforceable, the remaining provisions stay in effect. We may update these Terms from time to time and will post the updated version here with a revised date.
